The State of Himachal Pradesh and others have filed Civil Appeal Nos. 1276-1277 of 2023 against the judgment passed by the High Court of Himachal Pradesh at Shimla in Regular Second Appeal No.270 of 2007. The appeal was filed by the State of Himachal Pradesh after the High Court allowed the respondent’s appeal and quashed and set aside the judgment and decree passed by the trial court, which dismissed the suit filed by the respondent. The respondent sought declaration, mandatory injunction, and direction to initiate and complete the acquisition proceedings for his land. The road was constructed on his land without compensation and damaged his fruit-bearing trees. The trial court dismissed the suit due to limitation, which was confirmed by the first appellate court. The High Court allowed the second appeal filed by the respondent, and the State of Himachal Pradesh has appealed against the judgment.

The Supreme Court set aside the judgment of the High Court and dismisssed the suit due to limitation.
